General conditions of booking
CONTRACTUAL CONDITIONS OF CARRIAGE
Only people in possession of a ticket, issued by one of our offices, or an online booking voucher (showing the locator reference) – hereafter “Booking Voucher” – can board. Tickets or Booking Vouchers can be issued either in the name of an individual or group booking. The holder of a ticket or Booking Voucher is protected under the regulations Act of Law 1575/1989 of 22 December. Passengers booking via email should collect their ticket from one of our offices in the Port at least 30 minutes before boarding. Boarding takes place 10 minutes before the time of departure. Advance bookings, whether made by email or directly at any of our offices, must be paid in full in order for the booking to be confirmed.
The Ticket or Booking Voucher is only valid for travel on the date and time shown.
The boarding time limit is 10 minutes prior to the published time of departure. After this time no boarding will be allowed. MARCABRERA accepts no responsibility should a passenger or passengers be refused boarding. Missing the boat implies losing both the journey from Colònia de Sant Jordi to Cabrera and the return journey from Cabrera that were hired by the client. Passengers who do not board for reasons outside the control of the Carrier have no right to any refund of the cost of the ticket or Booking Voucher, nor to the 50% pre-booking charge referred to in number 3 above.
Cancellation conditions for reservations, tickets or Booking Vouchers
No refund will be allowed for cancellation by the passenger/s of a booking, a ticket or a Booking Voucher issued for a specific date if made 24 hours or less prior to the time of boarding. Tickets (whether booked on the same day or in advance) presented for cancellation less than 2 hours prior to the departure of the ship will not be reimbursed. If the departure for which the ticket or Booking Voucher has been issued does not take place for whatever reason, the Carrier will only refund the cost of the ticket or Booking Voucher in the following cases:
- If the cancellation request is made more than 48 hours before the boat’s scheduled departure time the ticket price will be refunded in full.
- Cancellations made 24 hours or less before the boat’s departure time will not be refunded, whether the booking has been made on the same day as the departure or in advance.
Refund of a ticket, Booking Voucher or reservation
Refunds will be made in the same form as the payment has been made at the time of the reservation.
The Carrier will accept no claim/complaint that is not accompanied by the corresponding ticket used by the passenger or the Booking Voucher showing the Locator reference. A passenger who does not board for any reason not concerning the Company’s control will not have any right for a refund of any ticket costs.
Times and itineraries may experience changes due to extraordinary circumstances or extreme weather conditions. In such cases the Carrier will take all reasonable actions to notify those passengers affected by the changes.
If the need arises, the Carrier is entitled to use another transport company or use other boats.
In case that the weather conditions do not impede the departure of the boat but the completion of the usual route, an alternative route will be taken and/or the stay time in Cabrera archipelago will be increased. This circumstance will not motivate the refound of the amount of the ticket nor a proportional part of it.
The Carrier holds an insurance policy covering the transport, subject to the conditions set out in the Compulsory Insurance for Travellers (Seguro Obligatorio de Viajeros).
We advise customers that boat tours are not advisable for passengers that are pregnant or with back problems. The passenger should inform the Carrier about any these conditions for advise. The Carrier will not accept responsibility for any injury, which may result.
Claims for loss or damage. The Carrier will only accept claims from passengers up to the limit of the cover provided by the Compulsory Insurance for Travellers.
The company accepts no responsibility for possible theft or loss of passengers’ personal effects. It is recommended that passengers keep their belongings with them at all times.
Any exclusion or limits to responsibility on the part of the Carrier also apply to their agents, employees and representatives, and to any person or entity whose boat is used by the Carrier for the transport of its agents, employees and representatives.
Banned objects. It is forbidden to carry as luggage, without the express permission of the company: pressurized gas (inflammable, non inflammable, poisonous); Corrosives such as acids, chemical inks, industrial batteries; explosives, munitions, fire crackers or any other article which is easily inflammable; inflammable liquids or solids such as matches, lighter fuel or alcohol; oxidising substances; poisons; radioactive material; other items, such as mercury, magnetic material, materials causing irritation and, generally, any product or object that could represent a danger to passengers or the boat. It is also strictly forbidden to take illicit substances on board.
Passengers are subject to police regulations for good behaviour. The captain will establish the rules of behaviour to be followed on board.
No employee, crew member, agent or representative of the company can modify or cancel any of the conditions in this contract.
If a question arises regarding the interpretation of any text written in a foreign language, the text written in Spanish is considered as the definitive version.
All the information provided by the passenger at the time of reservation or purchase of a ticket, either at our offices, through our website or at any other ticket sales channel, must be correct. Otherwise Marcabrera is not responsible for any problems that may arise. We reserve the right to not proceed to make the reservation or sale if we detect any error or inaccuracy in the data.
GENERAL CONDITIONS OF CONTRACT

VIII. RIGHT OF WITHDRAWAL
The right of withdrawal of the user/consumer, provided for in article 68 of Royal Legislative Decree 1/2007, of November 16th, is not applicable in this contract, since it is a service included in the exceptions to the right of withdrawal of consumers and users regulated by art. 103 of Royal Legislative Decree 1/2007, of November 16th.

- PROFESSIONALS.
If you are a professional or business owner, none of the provisions of Spanish Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the Spanish General Law on the Defence of Consumers and Users, will apply to this contracting process. If you are a professional or business owner, the clause governing the right of withdrawal and/or refund will not apply to this contracting process under any circumstances.
- ENTERING INTO THE CONTRACT.
Contracts shall be deemed entered into and produce all the effects provided for by law when consent and the other requirements necessary for their validity are met, and shall be governed by the provisions of Law 34/2002, of 11 July, on information society services and electronic commerce (LSSI), art. 23 and 24, the Civil Code, the Commercial Code and other applicable civil or mercantile regulations. If you are a consumer, it will be understood that this contract is entered into at the place where you have your primary residence. If you are a professional or business owner, it will be understood that this contract is entered into at the location of the registered address and/or premises of the company/entity.
- AMENDMENT.
The company/entity reserves the right to amend or replace these contracting terms and conditions in the event of new economic, commercial or regulatory circumstances and/or extraordinary circumstances that affect the sale of the product and/or provision of the service and/or aspects related thereto that justify any such amendment to these terms and conditions. Any unilateral amendments to these terms and conditions on justifiable grounds will not, under any circumstances whatsoever, affect the contracting terms and conditions governing those products, services or promotions that may have been accepted prior to such amendments.
- LIABILITY REGIME.
The company/entity will not be liable for problems due to lack of access or problems inherent to Internet connectivity or electricity networks when the causes are beyond its control or could not have been foreseen by the parties, or that, if foreseeable, the company/entity makes all reasonable efforts to avoid them or they are considered acts of god or force majeure.
The company/entity accepts no liability whatsoever for any delay to the performance of its obligations or failure to perform the same in the event that such non-compliance stems from a situation of force majeure, in accordance with the provisions of Article 1,105 of the Spanish Civil Code. Such circumstances will be communicated to the other party as soon as possible. The agreed delivery times will be extended for at least the period of time during which the situation of force majeure existed. If the situation of force majeure persists for more than three (3) months, either of the parties may terminate these contracting terms and conditions.
XIII. PROTECTION OF INTELLECTUAL PROPERTY.
CABRERA SEA FUN SL is the owner of the domain and the website www.marcabrera.com. The trademark is duly registered in the name of CABRERA SEA FUN SL . Likewise, the website www.marcabrera.com including, but not limited to, programming, editing, compilation, designs, logos, text and / or graphics, is the property of CABRERA SEA FUN SL , and is protected by national and international intellectual and industrial property law. Therefore, the holder of the rights expressly prohibits the use or reproduction, partial or total (by any physical or electronic means), by third parties, unless there is an agreement or written authorisation to this effect.
Access by the user to the website does not grant the user any ownership rights over the same. CABRERA SEA FUN SL shall take legal action as provided by law against those who knowingly and without authorisation carry out any of the aforementioned acts.
XIV. APPLICABLE LAW AND JURISDICTION.
These general conditions shall be governed by and interpreted in accordance with Spanish law in all matters not expressly established herein.
